Stay of proceedings granted for accused Bowden man

Charges tossed aside a month before scheduled preliminary inquiry

BOWDEN – A Bowden man charged a year ago with several drug and weapons charges has been granted a stay of proceeding on all alleged offences.

Lyle Andrus, 61, a resident of Bowden, was facing multiple charges a year ago following a lengthy investigation by Olds RCMP, with support from the RCMP Emergency Response Team, RCMP Police Dog Section, Southern Alberta District General Investigative Section, Alberta RCMP Interview Team and the Didsbury RCMP detachment.

Andrus was then facing three counts of possession for the purpose of trafficking, four counts of unauthorized possession of a firearm/prohibited weapon or restricted weapon and two counts of offences under the Cannabis Act.

On Nov. 24 an Alberta Court of Justice then granted a stay of proceeding on all charges, almost a month before he was scheduled for a preliminary hearing in Didsbury Court of Justice on Dec. 20.

A preliminary inquiry is a court hearing to determine if the Crown has enough evidence against an accused to proceed to trial.

A stay of proceeding is described as a suspension of court proceedings without resolution of guilt or innocence.
